I, the undersigned acknowledge the inherent risk involved when using any type of fitness equipment at and /or in the Renzo Gracie Brazilian Jiu-Jitsu Clarksville (RGC) facilities, and in all other sports and training sessions relating therein. Accordingly, as consideration in exchange for being allowed to participate in any exercise, fitness, athletic, porting, and/or other activities at and/or sponsored by RGC, I agree to the following:

1. I acknowledge and fully understand that I will be engaging in activities that involve risk of serious injury, or disease transmission such as influenza or COVID-19, which may include permanent disability and even death and severe social and economic losses which might result not only from my actions but also from the action, inaction or negligence of others, the use of the facilities and/or equipment, or condition of the premises, or any equipment used, and further that there may be risks not known to me or no reasonably foreseeable. I expressly assume all risks of injury, including death, which may occur in connection with my participation in activities at RGC.
2. I agree to assume all foregoing risks and accept full responsibility for my own damages following such injury, permanent disability, or death.
3. I release, waive, and discharge, and agree not to sue RGC, its owner, any parent company and any subsidiaries and all its respective agents, affiliates, associates, officers, directors, owners, and employees (collectively “Releases”) from demands, losses, damages on account of any bodily injury, death or property damage caused or alleged to be caused while or in part by Releases or any other party’s actions, inactions, or in part by my actions.
4. I consent to emergency medical care and transportation in order to obtain treatment in the event RGC deems appropriate. This release extends to any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency.
5. I expressly agree that the terms of the release and indemnity contained herein are intended to be as broad and inclusive as is permitted by the laws of the state of Tennessee. Any provision or portion of this Waiver, Release and Indemnity Agreement found to be invalid by the courts having jurisdiction shall be invalid only with respect to such provision or portion. The offending provision or portion shall be construed and enforced to the same effect as if such offending provision or portion thereof had not been contained herein.
6. In regard to any illnesses (such as influenza, strep, COVID-19, etc.), I understand that with physical contact comes the risk of virus transmission. I hereby agree, represent, and warrant that neither myself nor such participating children shall visit or utilize the facilities, services, and programs of RGC if he or (i) experiences symptoms of illness, including, without limitation, fever, cough or shortness of breath, or (ii) has a suspected or diagnosed/confirmed case of illness. In the event of a confirmed COVID-19 diagnosis the undersigned agrees to notify the RGC management immediately and to self-quarantine as appropriate.
7. In further consideration of being permitted to enter RGC for any purposes including, but not limited to, observation of use of facilities or equipment, I have carefully read and voluntarily sign this assumption of risk, release and waiver of liability and indemnity agreement and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made. I am aware that by agreeing to this waiver I am giving up valuable legal rights including the right to recover damages from RGC in case of illness, injury, death or property loss or damage, including, for the avoidance of doubt and without limitation, exposure to illness such as COVID-19 at any RGC facility, event, or program and any illness, injury or death resulting therefrom.
8. I understand that this document is a promise not to sue and release indemnification for all claims. If signing on the behalf of a minor: I also understand that this agreement is made on behalf of my minor child(ren) and/or legal wards and I represent and warrant to RGC that I have full authority to sign this agreement on behalf of such minor(s).
9. I hereby acknowledge that photos or video of me or my minor children in the course of a class, seminar, or event may or may not be used for the express purposes of marketing for Renzo Gracie Clarksville. I recognize that if I prefer my images not be used I must submit a request in writing to info@rgclarksville.com for the purposes of proper documentation.
